Under the Microscope: Supervision and Work Restrictions

One of the most life-altering aspects of nursing probation is the restriction on where and how you can work. The Recommended Guidelines for Disciplinary Orders and Conditions of Probation establish "Condition 9: Employment Limitations" and "Condition 8: Supervision" to ensure you are never in a position where you could harm a patient without oversight.

The Board’s standard employment limitations in the guidelines often include:

  • No work for a nurse’s registry or temporary staffing agency.

  • No private duty nursing or home health care positions.

  • No work as a "traveling nurse."

  • No supervising other registered nurses or teaching in a nursing program.

The level of supervision required (Condition 8) can vary based on your violation. It often ranges from "Maximum" (a supervisor must be present at all times) to "Minimum" (the supervisor must check in with you twice per shift). Your supervisor must be a registered nurse in good standing who has been approved by the Board in advance.

These restrictions can make finding a job difficult. Many employers are hesitant to take on the responsibility of supervising a nurse on probation. You will need to identify "probation-friendly" employers and draft the necessary "Employment Approval" requests to submit to the Board.

It is also important to remember that per the Recommended Guidelines, your probation time only counts toward completion if you are actually working as a nurse for at least 24 hours per week. If you cannot find a job that meets the Board's supervision requirements, your probation period will be extended. "Talk to a Nursing License Defense Attorney"
