Substance Abuse and the RN: Navigating Section 2762

The BRN takes violations involving drugs and alcohol very seriously, as chemical impairment is a direct threat to patient safety. Under Section 2762, the Recommended Guidelines for Disciplinary Orders and Conditions of Probation state that the standard recommendation for illegally obtaining, possessing, or administering narcotics is revocation. This is especially true if a nurse substitutes drugs on the job.
However, the guidelines also recognize the possibility of recovery. For a first-time offense with documented evidence of an ongoing rehabilitation program, the Board may offer a minimum discipline of revocation stayed with three years of probation.
