Clinical Errors: Moving from Negligence to Compliance

Clinical errors—categorized by the BRN as Incompetence or Gross Negligence—are among the most daunting charges a nurse can face.
Under Section 2761(a)(1) of the Business and Professions Code, the Board’s recommended discipline for these failures is revocation.
This is because the Board believes clinical failures directly compromise its core mission of consumer protection, as outlined in the Recommended Guidelines for Disciplinary Orders and Conditions of Probation.
However, the guidelines also allow for a minimum discipline:
